Photo competition Terms & Conditions

The "Kauri Dieback Management Programme" ("the Programme") is a common initiative by the Ministry for Primary Industries, the Department of Conservation, Northland Regional Council, Waikato Regional Council, Bay of Plenty Regional Council, Tāngata Whenua and Auckland Council ("the Partner Agencies") to protect high value areas and iconic kauri trees.

Auckland Council is managing this Competition, on behalf of the Programme, in order to further raise public awareness to help stop the spread of the kauri dieback.  The Programme is funding all prizes associated with the Competition.

By entering this Competition, entrants are deemed to have read, understood and accepted the following terms and conditions:

A. Competition

1. The Competition is for the best monthly picture celebrating a kauri tree ("the Picture").

2. To enter, entrants must post their picture(s) to the Kauri Dieback Management Programme's Facebook page ("the Facebook Page"). The Competition will run every month, commencing on the 1st of every month.

3. The Pictures must show a kauri tree and be at least 1MB in size, but not larger than 12MB each. Each entrant can submit up to 3 pictures per month. If an entrant submits more than 3 pictures or a picture larger than 12 MB, the entrant will be disqualified for that month.

4. Entries for the respective month must be submitted at the latest by 12pm on the last day of the month. Entries received after that time will automatically go into the draw for the next month.

5. Every picture will be moderated and any picture with inappropriate content will be excluded and the entrant disqualified from the Competition.

6. Every entrant warrants that submitted pictures do not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the picture(s) submitted. The Programme reserves the right to remove any picture(s) and disqualify the respective entrant immediately if it has reason to believe that publication of the picture would be in breach of a third party's copyright or any other right or claim.

7. By entering the Competition, entrants warrant that all information submitted by them is true, current and complete.

B. Entries, selection and prize draw

8. The Competition is open to members of the public aged 18 years and over.

9. Each month one winner will be selected. The winner's name will be published on the Facebook Page on the first week day of each month. The winner will be contacted by private message on Facebook.

10. If the winner does not respond to the message within 72 hours, another winner will be selected.

11. The decision by the Programme is final and no correspondence will be entered into.

C. Prizes

12. The prizes for the monthly winner(s) will be a cleaning kit, a Kauri Dieback Programme branded t-shirt or a Kauri Dieback Programme branded cap.

13. In December 2014 an overall winner and runner up will be selected from all entrants who have submitted pictures during the year. That winner will receive a Canon Powershot sx280 camera (valued at $316.82) and the runner up will receive a $50 Bivouac Outdoors voucher.

14. Prizes are not redeemable for cash, are not transferable to any other person, and cannot be used in conjunction with any other offer or promotion.

15. If any of the prizes become unavailable (for any reason), the Programme reserves the right to provide the winner with a substitute prize.

D. Privacy

16. The information provided on the Facebook Page will be used to contact the winner. In addition, all winners consent to the Programme using their picture(s) for promotional purposes to be displayed on the Programme website (, the Facebook Page and other media.

17. All winners also consent to participate and co-operate as required in all promotional activities relating to the Competition by the Programme and its Partner Agencies.

18. Submitted pictures will not be returned or deleted. All entrants and winners agree to provide the Programme with an unlimited, irrevocable, perpetual, royalty-free and non-exclusive license to reproduce, distribute, display, and create derivative works of the pictures (along with a name credit) in connection with the Competition and promotion of the Programme.

19. All information provided by the entrants will be collected, used, stored, disclosed and corrected in accordance with the Privacy Act 1993. All entrants have the right to access their information and request for any personal information to be corrected.

E. Exclusions

20. The Programme would like to receive pictures from as many people as possible. Apart from the winning pictures, the Programme might also publish other submitted pictures on its website and the Facebook Page which comply with these Terms and Conditions. However, the following persons are not eligible to win any prize:

a. Anyone under the age of 18 at the time of entering the competition.

b. Anyone not resident in New Zealand at the time of the selection.

c. Anyone who works for the Programme and their immediate family members.

21. The Programme reserves the right to exclude any entrant from participating in the Competition at its sole discretion. It also reserves the right to refuse to award a prize to an entrant who is in breach of these Terms and Conditions, gained an unfair advantage in participating in the competition or won a prize by using fraudulent means.

22. The Programme will not be liable for any claims for loss, damage or injury whatsoever or for any physical or mental injury suffered by the winner(s) as a result of or in connection with the Competition or due to any prizes won in the Competition.

23. These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the non-exclusive jurisdiction of New Zealand courts.
